Terms of Service

Last updated: 2026-10-23

1. Who we are

OBX Charter is operated by That's a Big Idea LLC, a North Carolina limited liability company ("we", "us", "the platform"). You can reach us at[email protected]or (252) 573-5666.

2. What the platform is — and what it is not

OBX Charter is a marketplace. We provide a venue where customers can find and book fishing trips offered by independent, licensed charter captains, and where those captains can list trips, manage availability and receive payment.

The captain is the provider of the trip. Captains are independent operators, not our employees, agents or partners. Each captain is solely responsible for the safe operation of their vessel, for compliance with all applicable laws, and for the conduct of the trip. We do not own or operate vessels and we do not provide the charter service itself.

We verify that captains hold the licenses and permits described in section 5 at the time of onboarding, but we do not supervise, direct or control any trip.

3. Booking and payment

Bookings are made through the platform and paid through our payment processor, Stripe. Trip payments are made to the captain's own account through Stripe Connect; we do not hold trip funds. By booking, you agree to Stripe's terms in addition to these terms.

Prices shown on a trip page are set by the captain. We take no commissionon trip revenue.

4. Cancellations, weather and safety

  • Weather. The captain makes the safety call. If a trip is cancelled by the captain because conditions are unsafe, you are entitled to a refund or a reschedule, at your election.
  • Customer cancellation. Cancellation terms are set by the captain and shown on the trip page before you pay. Deposit and refund handling follows those terms.
  • No-show. If you do not arrive for a booked trip, the captain's stated no-show terms apply.

Because safety decisions are the captain's, we cannot guarantee that any particular trip will depart or that any particular species will be caught.

5. Captain obligations

To list trips on the platform, a captain must:

  • Hold and maintain a valid US Coast Guard license;
  • Hold and maintain the required North Carolina for-hire permit;
  • Hold and maintain commercial liability insurance for the vessel and operation;
  • Keep availability, pricing and trip details accurate; and
  • Comply with all applicable federal, state and local law, including catch limits and seasons.

We may suspend or remove a listing, and cancel a membership, if these obligations are not met.

6. Captain membership

Captain participation is a paid membership billed monthly through Stripe. The current promotional rate is $249 per month; the standard rate is$399 per month. New captains receive a 60-day free trial. Memberships carry a six-month commitment, after which they continue month to month and may be cancelled at any time.

Promotional pricing applies for as long as the membership remains continuously active on promotional terms. We will give notice before any change to the rate you pay.

7. Acceptable use

You agree not to:

  • Provide false information, including false license, permit or insurance details;
  • Use the platform to harass, defraud or deceive any person;
  • Attempt to interfere with, scrape at scale, or gain unauthorised access to the platform;
  • Post content that is unlawful, infringing, or that you do not have the right to publish.

8. Reviews and content

You retain ownership of content you submit. By submitting it you grant us a non-exclusive licence to display it on the platform and in related marketing. We may remove content that breaches these terms.

9. Disclaimers and limitation of liability

The platform is provided "as is". To the fullest extent permitted by law, we disclaim all warranties, express or implied. We are not liable for the acts or omissions of any captain or customer, for the condition or operation of any vessel, or for any injury, loss or damage arising from a trip.

To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to the platform is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) one hundred US dollars. We are not liable for indirect, incidental, special, consequential or punitive damages.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence where such exclusion is prohibited.

10. Indemnity

You agree to indemnify and hold harmless That's a Big Idea LLC and its members, officers and employees from any claim, loss or expense (including reasonable legal fees) arising from your breach of these terms, your use of the platform, or — in the case of a captain — the operation of any trip.

11. Governing law and disputes

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. The state and federal courts located in North Carolina have exclusive jurisdiction over any dispute arising from these terms or the platform.

Before filing any claim, you agree to contact us at[email protected]and give us 30 days to attempt to resolve the matter informally.

12. Changes

We may update these terms. Material changes will be posted on this page with a new "last updated" date. Continuing to use the platform after a change means you accept the updated terms.
